Its cost-cutting and debt-slashing efforts paid off with net income soaring to $0.12 a share after clocking in at a $0.07 a share a year earlier. Analysts were only holding out for $0.05 a share.     HONG KONG (MarketWatch) -- Hong Kong stocks rose early Wednesday, with the Hang Seng Index (HK:HSI) up 0.2% at 22,587.72. Hong Kong properties advanced, as the city's major developer Sun Hung Kai Properties Ltd. The comments section on any site can be engaging, annoying, puzzling, insulting—likely many more adjectives could apply.

But the best comments can help continue the conversation of any story or blog for our readers—and for us—beyond the article’s own words.  So AdvisorOne will be regularly highlighting some of the better comments that are posted to keep the conversation alive. Bob, an excellent article on a confusing case. Due to the confidentiality of CFP Board disciplinary proceedings, we are never likely to obtain a full knowledge of the facts, even in summary form, as they were presented at the CFP Board hearing. Accepting Alan Goldfarb's statements as both true and complete (which I do, for he has long been a man of honor and a leader of the profession), I remain perplexed about two aspects of the CFP Board's ruling to (1) find that a violation occurred; and (2) impose the draconian penalty of a public sanction.

FIRST, there does not appear to be any explanation of the term "salary" on the CFP Board's web site. I receive a salary from my fee-only investment advisory firm; can I use the term "salary"? Or, since all compensation DERIVES from either fee compensation (i.e., paid directly by the client) or commission-based compensation, should all advisors describe themselves as either "fee-only" or "fee-and-commission" or "commission-and-fee" or "commission-only" on the CFP Board's web site? In other words, who - if anyone - is permitted to utilize the term "salary"? Given such, is the misunderstanding that occurred not the fault of Mr. Goldfarb, but rather the fault of the CFP Board? And ... would not others have been caught in the trap of this ambiguity - and what happened to their cases?

SECOND, why a public sanction for such the alleged seemingly minor transgression - if it was a transgression at all? It seems that other disclosures provided by Alan Goldfarb and his firm corrected any misunderstanding any client or potential client would possess - if indeed there was any violation at all, and if indeed any client or potential client was confused by the language found on the CFP Board's web site. Alan Goldfarb was apparently thorough and prompt in his reply to the CFP Board. Moreover, Alan Goldfarb very publicly resigned his CFP Board Chairmanship in order to preserve the reputation of the CFP Board while this investigation was pending. In other words, there does not appear to be any harm to Alan Goldfarb's clients, nor to the public. And Mr. Goldfarb, by his very public resignation last year, already burdened himself with public discussion of the situation. Are the CFP Board's disciplinary guidelines, as to sanctions imposed for the alleged offense, so uncompromisingly rigid that a public sanction was warranted (even assuming, again, that a transgression of the CFP Board's rules even occurred)? You characterize the case as "curious." I would go further, and say that the CFP Board's decision in this matter poses a grave concern.

At the minimum, and without reference to any particular case before it (now or in the past), the CFP Board should adequately and prominently define for its Certificants the term "salary" and specify the circumstances in which it can be utilized (and when it cannot). Even then, any retrospective application of such an explanation appears unjust and a denial of due process - not only for Alan Goldfarb, but also for any other persons trapped by the ambiguity which has been so created by the CFP Board.

Bob, your old pal Mary Malgoire here. Excellent article... I would like to clarify one thing about NAPFA's standards for admission. We recognize that some fee-only advisors are indeed salaried professionals in a stand-alone business unit that is owned by a commission-based firm. Since there could be expectations, even incentives, to refer business to the "product side" of the house. NAPFA requires a signed statement from the salaried individual's supervisor that said professional has NO obligation to recommend the subsidiaries products and may recommend ANY product that is suitable for the client. In some situations the applicant's supervisor refuses to sign such a statement. That tells you something!

So my quesiton here is whether or not Mr. Goldfarb was under any obligation to satisfy client product needs via the firm's subsidiaries? The ADV Part 2 also helps NAPFA to understand and can enlighten. I too hope the CFP Board and other professional associations will clarify these issues as my own investigation indicates that there are many professionals associated with commission and fee firms who claim "fee-only" on "find a planner' searches. If the firm's website lists a broker-dealer affiliation, it is a misrepresentation to the public to list yourself as fee-only? My solution to all of this, as I said at the Fiduciary Summit yesterday, is to simply require dislcosure of the adviser's (and advisory firm's) actual $ financial interest and let the marketplace work it's magic.

The larger problem with indexed funds is that they have little if any incentive to actually monitor management since they compete with other indexed funds on the basis of low fees. Any benefit that occurs because of their active monitoring goes equally to their competitors, but every dime they spend is only their own expense. We have reached the point that a majority or close to a majority of stock in most large companies is held by indexed funds. The result is that either they defer to management (which I suspect is most frequently the case) or they defer to ISS and Glass Lewis. Either way is problematic. I discuss this more thoroughly in a three part post, beginning with "Agency Capitalism: Corrective Measures (Part 1)." My post includes suggested solutions, including proxy advisor contests, which will allow much more time and analysis than the estimated average of $2,000 per proxy spent by ISS.

What a Pretzel Entrepreneur, a Navy Widow and an Ex-Rep All Need From Their Advisors Investment Advisor Editor-in-Chief John Sullivan wrote this news piece on June 14, 2013, from the TD Ameritrade Institutional Elite Advisor’s conference, reporting on a consumer panel moderated by Barbara Roper of the Consumer Federation of America. “The panel, convened to discuss consumer awareness of the concept of fiduciary, quickly deviated into other issues, as panelists agreed that acting in their best interest was important even if they never heard the term ‘fiduciary’ used in that context.”

What was the point of the article? Has anyone asked the CFPBOS [the CFP Board of Standards] why for decades they actively fought the imposition of a fiduciary standard? If it was core to the practice then it would have been embraced at the onset.

Paul, a lot of good points. One key is understanding why people make referrals. We all engage in referral behavior all the time, and it is because we get rewards for it. Advisors do not widely understand this, and so they think we have to pry them out of clients, totally disrespecting why the client would do it and actually helping prevent future referrals. Also, as you point out, clients do not generally understand who to refer. Addressing these issues, like I do on my blog , The Client-Driven Practice,  and other places, you can get people referring -- without asking! There is also more about this in the interview I did with Investment Advisor magazine last August: How to Succeed at Referrals (Without Even Asking).

EnPro Reaches 52-Week High - Analyst Blog

Hot Japanese Companies To Own In Right Now

Shares of EnPro Industries, Inc. (NPO) hit a new 52-week high of $57.04 on Jul 10 and eventually closed at $56.86. Shares of this industrial products company jumped 7.2% in a day, post the announcement of the recent decline in the estimated liability of pending and future asbestos-related claims.

Year-to-date, share prices have recorded a healthy return of 35.8%. The company's long-term estimated EPS growth rate is 15.0%. Average volume of shares traded over the last three months came in at approximately 130K.

EnPro announced the new development by Garlock Sealing Technologies LLC (GST) against whom the allegation of manufacturing asbestos which is causing cancer has been leveled. Garlock has submitted a pre-trial brief for the impending trial to estimate its aggregate charge for pending and future mesothelioma claims.

Garlock estimated claims of $270 million in Nov 2011, which is now estimated to be roughly $125 million, in the pre-trial brief issued recently. However, the Committee of Asbestos Personal Injury Claimants and the Future Asbestos Claimants' Representative estimate the claim to be $1.26 billion.

In May, another subsidiary of EnPro, Compressor Products International, entered into a contract to provide reciprocating compressor aftermarket goods and services for the next five years to Shell.

In April, GGB Bearing Technology enhanced the product portfolio of the company with the introduction of two new metallic bearing materials. We expect the growth trajectory to continue in the future based on new contracts as well as offerings.

Other Stocks to Consider

The company registered a negative earnings surprise in the previous quarter due to reduction in demand in most of its industrial markets. EnPro currently carries a Zacks Rank #4 (Sell). Other stocks to look out for in the industry are Lincoln! Electric Holdings Inc. (LECO), carrying a Zacks Rank #1 (Strong Buy). Chart Industries Inc. (GTLS) and Key Technology, Inc. P&G Rises On Q2 Beat; Lafley Promises Focus, Cost Cutting

Procter & Gamble (PG) was rising more than 1% this morning on a better-than-expected second quarter.

The company said it earned $1.88 billion, or 79 cents a share, down from $3.63 billion a year earlier. Revenue rose 2.2% to $20.66 billion.

Analysts were looking for earnings of 77 cents per share on revenue of $20.54 billion.

The company's full-year guidance came in light, however. P&G said it will see earnings per share grow 5% to 7%, to a range of $4.25 a share to $4.33 a share, while the consensus estimate is $4.32.

In the quarter, organic sales climbed rose 4%; the company said it expects sales to grow between 1% and 2% for the full year, while organic sales rise 3% to 4%.

Gross margin narrowed to 47.5% from 48.1%.

CEO A.G. Lafley also spoke publicly for the first time since retaking the corner office, saying he would redouble efforts to win more market share and cut costs.

S&P Capital IQ's Ian Gordon reiterated a Hold rating on the stock, but sounded an upbeat note, boosting his target price by $2 to $85 and writing "We see a focus on productivity enabling PG to drive EPS growth more in line with peers in FY 15 and beyond."

P&G is up more than 26% for the year, slightly outpacing the broader market.

A rebounding economy has been good news for Warren Buffett�� Berkshire Hathaway (BRK. A).

The company�� second-quarter results, released late Friday, rose more than expected as its investment portfolio gained in value and dozens of operating businesses owned by the holding company reported growth.

Net income climbed to $6.4 billion, or $3,889 per Class A share, from $4.54 billion, or $2,763 per Class A share a year earlier. Operating earnings, which exclude some investment results, were $2,634 per Class A share.

Revenue rose to $49.76 billion from $44.69 billion.

Analysts expected operating earnings of $2,485.21 per Class A share, and operating earnings of $1.66 per Class B share on revenue of $48.86 million.

    Wednesday proved to be another example of the resiliency of the bull market in stocks, as major market benchmarks bounced back from yesterday's losses to regain a substantial chunk of their lost ground. Even though U.S. GDP figures for the first quarter got revised downward to an ugly drop of 2.9%, few investors believe that the decline is anything but a one-time seasonal aberration.     Barclays upgraded share s of Vitamin Shoppe (VSI) today, expressing a confidence in management that was, well, heartwarming.

    Barclays’ analysts Meredith Adler and Sean Kras call Vitamin Shoppe’s management team “thoughtful, deliberate and disciplined” and praise their ability to diversify the business. As a result, they upgraded Vitamin Shoppe to Overweight from Equal Weight two days after Vitamin Shoppe released its earnings.

    But Adler and Kras also spent a good number of words explaining what Vitamin Shoppe isn’t–specifically, it’s not GNC Holdings (GNC):

    [Vitamin Shoppe] said it saw no fundamental change in consumer demand, nor did it feel much pressure from the bad media reports about things like multi-vitamins and fish oil, unlike GNC. [Vitamin Shoppe] has a much broader offering than GNC, however, so weakness in any one category rarely has a major impact on�[Vitamin Shoppe's] overall sales the way it does at GNC. Conversely, it benefits less when there are few very successful products. For example, diet is a far smaller part of the sales mix at�[Vitamin Shoppe] than at GNC. Last year diet had some strong products, but this year there are fewer. Brendan Byrnes: So let's talk about International. You guys get about 75% of your revenues from the United States. That's been pretty consistent over the past few years. Where do you see the opportunity internationally for LivePerson?

Robert LoCascio: Well, we just bought a company in Australia, so we're doing very well there. We had a partner there for the last two years and we decided to buy them. I think we're going to start to expand in Asia. There's a lot of opportunity between Japan and China, South Korea. Even look at Indonesia's got 300 million people, so these are untapped markets. South America, Brazil, we're looking at these areas, so we're really dominant here, but there's an opportunity now to expand between Europe, South America, and Asia and we're going to look at that over the next year or two years.

Top Life Sciences Stocks To Own For 2015

No sooner had Life Technologies Corp. (NASDAQ: LIFE  ) announced its successful purchase of KDR Biotech last week, then out came Thermo Fisher Scientific (NYSE: TMO  ) with a $13.6 billion bid to buy Life Technologies itself.

This morning, Life Technologies announced that it has signed a definitive agreement to sell itself to Thermo Fisher for $76 per share, or about $13.6 billion in total plus assumption of $2.2 billion in net debt. That assumption raises the deal value to $15.8 billion in total, easily trumping what was being reported last week as an estimated $11 billion bid for Life Technologies from private equity powerhouses Blackstone, Carlyle Group, and KKR.

The deal must be approved by shareholders and needs regulatory approval.

Thermo Fisher CEO Marc N. Casper was quoted in the company press release as saying that "Life Technologies enhances all three elements of our growth strategy: technological innovation, a unique customer value proposition and expansion in emerging markets." Life Technologies and Thermo Fisher say the deal will build on their "technological strengths to accelerate results for life sciences customers working in proteomics, genomics and cell biology."

In addition, Ryland Mortgage Company and its subsidiaries, and RMC Mortgage Corporation (collectively referred to as RMC) provide mortgage financing and related services. All of the Company's business is conducted and located in the United States. The Company's operations span aspects of the home buying process from design, construction and sale to mortgage origination, title insurance, escrow and insurance services. During the year ended December 31, 2012, the homebuilding operations were consisted of approximately 97% of consolidated revenues. The homebuilding segments generate their revenues from sales of completed homes, with sales of land and lots. The Company builds homes for entry-level buyers, as well as for first- and second-time move-up buyers. In July 2012, the Company acquired Charlotte and Raleigh operations and assets of Timberstone Homes. In December 2012, the Company acquired Phoenix operations and assets of Trend Homes. In June 2013, Ryland Group Inc acquired LionsGate Homes Corp. Effective July 19, 2013, Ryland Group Inc acquired Cornell Homes, a media-based construction company.

Homebuilding

The Company's homes are built on-site and marketed in four geographic regions or segments: North, Southeast, Texas and West. Its North segment includes Baltimore, Chicago, Indianapolis, Minneapolis, Northern Virginia and Washington, D.C. Its Southeast include Atlanta, Charleston, Charlotte, Orlando and Tampa. Texas includes Austin, Houston and San Antonio. West includes Denver, Las Vegas and Southern California. During 2012, within each of those segments, the Company operated in the metropolitan areas of North, Southeast, Texas and West. Each of its homebuilding divisions across the country consists of a division president; a controller; management personnel focused on land entitlement, acquisition and development, sales, construction, customer service and purchasin! g, and accounting and administrative personnel. The Company markets attached and detached single-family homes. In the Company's single-family detached home communities, it offers at least four different floor plans. The Company's attached home communities offer different floor plans with two, three or four bedrooms. The Company relies on its own architectural staff and also engages unaffiliated architectural firms to develop new designs. Homebuyers are able to customize certain features of their homes by selecting from options and upgrades displayed in the Company's model homes and design centers. In all of the Company's communities, a range of options is available to homebuyers for additional charges. The number and complexity of options increase with the size and base selling price of the home. During 2012, custom options contributed 16.9% of homebuilding revenues.

The Company's financial services segment provides mortgage-related products and services, as well as title, escrow and insurance services, to its homebuyers. The Company's financial services segment includes RMC, RH Insurance Company, Inc. (RHIC), LPS Holdings Corporation and its subsidiaries (LPS), and Columbia National Risk Retention Group, Inc. (CNRRG). By aligning its operations with the Company's homebuilding segments, the financial services segment leverages this relationship to offer its lending services to homebuyers.

During 2012, RMC's mortgage origination operations consisted of the Company's homebuilder loans, which were originated in connection with sales of the Company's homes. During 2012, mortgage operations originated 3,039 loans, which used for purchasing homes built by the Company and for purchasing homes built by others, purchasing existing homes or refinancing existing mortgage loans. RMC arranges various types of mortgage financing, including conventional, Federal Housing Administration (FHA) and Veterans Administration (VA) mortgages, with various fixed- and adjustable-rate features. The Compa! ny sells ! the loans it originates, along with the related servicing rights, to others. Cornerstone Title Company, doing business as Ryland Title Company, is a 100 % subsidiary of RMC, provides escrow and title services and acts as a title insurance agent primarily for the Company's homebuyers. As of December 31, 2012, it provided title services in Arizona, Colorado, Florida, Illinois, Indiana, Maryland, Minnesota, Nevada, Texas and Virginia. Ryland Insurance Services (RIS), a 100 % owned subsidiary of RMC, provides insurance services to the Company's homebuyers. As of December 31, 2012, RIS was licensed to operate in all of the states in which the Company's homebuilding segments operate. During 2012, it provided insurance services to 41.5 % of the Company's homebuyers. CNRRG, a 100 %-owned subsidiary of the Company and some of its affiliates, offer insurance, specifically structural warranty coverage, to protect homeowners against liability risks arising in connection with the homebuilding business of the Company and its affiliates.

    Graham increased assumed ROI's to 9% on average from 7%. Reduced targeted sector price/ book from $190% to 170%. Expects 20-30% growth in starts and new home sales in 2012 and 2013 to stabilize in 2014 and on at approximately 10%. For covered builders, the analyst lowered estimates by 8% and lowered price targets by 10%. Compass Point expects 10% annual growth in single family starts and new home sales and 2-5% pricing growth. Downgraded DR Horton Inc. (NYSE: DHI) from Buy to Neutral and KB Home (NYSE: KBH) from Neutral to Sell. DR Horton's and KB Home's PT was lowered from $23.50 to $20.00 and from $17.50 to $14.00, respectively. Graham reiterated a Buy rating on Ryland Group Inc. (NYSE: RYL) and Standard Pacific Corp. (NYSE: SPF). The analyst raised the PT on Ryland from $50.00 to $50.50 and lowered the PT on Standard Pacific from $10.00 to $9.50. Compass Point reiterated a Neutral rating on Beazer Homes USA Inc. (NYSE: BZH), Hovnanian Enterprises Inc. (NYSE: HOV), Lennar Corp. (NYSE: LEN), PulteGroup, Inc. (NYSE: PHM), and Toll Brothers Inc. (NYSE: TOL). The price target for Beazer and Hovnanian was raised from $15.50 to $24.00 and $5.00 to $5.75, respectively. Graham lowered the PT for Lennar, Pulte, and Toll to $34.50, $17.00, and $31.00.
